By accessing or using Surplus 4 All’s platform, you agree to abide by the following terms. These Terms & Conditions govern your access to, and use of, our ecommerce and auction services as a buyer, seller, or visitor.

1. General Terms of Use

  • You must be at least 18 years of age and legally capable of entering into contracts to use our services.

  • Use of the website for any illegal or unauthorized purpose is strictly prohibited.

  • Surplus 4 All reserves the right to refuse service, terminate accounts, or cancel transactions at any time for any reason.

  • Access to the site is provided “as-is” without warranties of any kind.

2. Account Registration

  • You must create an account to place bids, make purchases, or list items for sale.

  • All information provided must be accurate and up-to-date.

  • You are responsible for safeguarding your login credentials and for all activity under your account.

3. Ecommerce & Auction Participation

3.1 Product Listings

  • Product locations are in Downey, California, unless otherwise specified.

  • All items are sold in their current condition ("as-is, where-is").

  • Photos and descriptions are for reference only and may not reflect actual condition.

  • It is the buyer’s responsibility to inspect or inquire about item condition before bidding or purchasing.

3.2 Bidding & Buying

  • All auction bids are binding and final. Once a lot is awarded to the highest bidder, payment is due.

  • “Buy Now” ecommerce purchases are also final, with no cancellations.

  • Winning bids and purchases will be automatically charged to the credit card on file.

3.3 Pickup & Removal

  • Pickup days are specified on the product page and confirmation emails.

    • Upcoming example: Wednesday, June 4; Saturday, June 7; Sunday, June 8 (9 AM – 5 PM)

  • Buyers are responsible for loading and removing their items. Forklifts may be available for assistance.

  • No shipping is provided by Surplus 4 All unless otherwise stated.

  • Deadline for removal: No later than Sunday, June 8, at 5 PM

    • Storage Fee: $20/day per item for items left beyond deadline unless arrangements are made in advance.

    • Unclaimed Items: Items not paid for or removed will be forfeited without refund.

3.4 Disposal & Clean-Up Fees

  • A $20 disposal fee will be charged for any trash, cardboard boxes, pallets, or unwanted goods left on-site.

4. Payment Terms

  • Accepted Methods: Credit cards only unless special arrangements are made in writing.

  • Fees Applied to All Orders:

    • 15% Buyer’s Premium

    • 3% Credit Card Processing Fee

    • 10.5% California Sales Tax (exempt only with valid resale permit)

  • All sales are final. No refunds or returns.

5. Selling on Surplus 4 All

  • Sellers must be approved by Surplus 4 All.

  • Items must be accurately described and available for inspection.

  • Sellers are responsible for product delivery or pickup arrangements unless listed under our facilities.

  • Surplus 4 All may deduct commissions and fees per the consignment or seller agreement.

  • Listings found to be fraudulent, inaccurate, or in violation of laws will be removed.

6. Mobile Messaging Terms

  • By registering or participating in auctions, you agree to receive SMS/MMS messages from Surplus 4 All.

  • Messages may include:

    • Auction start and end reminders

    • Pickup instructions

    • Promotions or sales updates

  • Frequency: Up to 2 messages per week

  • Msg & Data Rates May Apply.

  • To unsubscribe, text "STOP" at any time.

7. Limitations of Liability

  • Surplus 4 All is not liable for:

    • Damage or injury resulting from item use

    • Delayed pickups or delivery issues

    • Technical glitches or listing errors

    • Losses incurred due to seller/buyer misrepresentation

  • Users agree to indemnify and hold Surplus 4 All harmless from any claims arising from the use of the platform.

8. Privacy & Security

  • We value your privacy. Personal data is protected under our Privacy Policy (coming soon).

  • Payment information is processed securely via third-party payment processors.

  • We do not sell or share your personal data with unauthorized third parties.

9. Termination & Suspension

  • We may suspend or terminate your access at any time if you violate these terms.

  • You may request account closure at any time via email.

10. Modifications to Terms

  • Surplus 4 All may update these Terms & Conditions at any time.

  • We will notify users of significant changes via email or site notification.

  • Continued use after changes constitutes acceptance of the new terms.
